  • Masoabi, P. (2004) Police Complaints Authority: Lesotho.
Paper presented at the Policing Oversight and Accountability Conference, Sandton, South Africa, 26-29 January 2004. The author discusses the implications of the promulgation of Lesotho’s amended constitution (1993), especially its Bill of Rights, for accountable policing. An overview is thus provided of the legal framework for the control of the police in terms of the Lesotho Police Act (1998); police powers under the Criminal Procedure and Evidence Act (1981) and the role of the courts in controlling these powers; and control mechanisms within the police in terms of the Police Complaints Authority. The origin, mandate and duties of the Authority are subsequently discussed as well as the process in which a set of internal procedures and disciplinary regulations, applicable to the police service, were established. The author concludes with a brief review of the main successes and challenges facing the Authority and the police service.
